On January 20, 2021, President Biden issued an executive order directing all federal agencies to interpret protections against discrimination based on sex to include discrimination based on sexual orientation, gender identity, and gender expression.

On February 11, 2021, the Department of Housing and Urban Development (HUD) issued a memorandum announcing its implementation of that order.

Accordingly, the agency “will administer and enforce the Fair Housing Act to prohibit discrimination on the basis of sexual orientation and gender identity.”
