Is Your Form I‑9 Process Ready for the August 1, 2026 Change?

Beginning August 1, 2026, employers must use a Form I‑9 displaying the May 31, 2027 expiration date. Forms displaying the July 31, 2026 expiration date may no longer be used for new completions after that deadline.

But using the correct form is only the beginning.

Electronic records, remote document examination, E‑Verify procedures, Supplements A and B, reverification, document retention, corrections and anti-discrimination requirements can all create exposure when they are misunderstood or applied inconsistently.

What Has Changed—and Why It Matters

The current Form I‑9 carries an 01/20/25 edition date and a 05/31/2027 expiration date. Recent updates also changed terminology in Form I‑9 and E‑Verify, including replacing “noncitizen authorized to work” with “alien authorized to work.”

Employers must now ensure that their:

  • Blank forms and electronic systems display an acceptable version
  • Hiring teams follow the current completion timelines
  • Remote-verification procedures meet every required condition
  • Supplement A and Supplement B are used correctly
  • Electronic records preserve required histories and audit trails
  • Corrections are transparent, dated and properly documented
  • Reverification practices do not create discrimination concerns
  • Records can be located and produced promptly during an inspection

A government inspection generally provides employers with only a limited period to produce their Forms I‑9. Waiting until a notice arrives to organize incomplete, inconsistent or inaccessible records can be costly.

Special Focus: Remote Verification Is Not Simply a Video Call

Employers using the DHS-authorized alternative procedure must participate in E‑Verify in good standing at the relevant hiring site and follow the complete remote-examination process.

That includes examining document copies, conducting a live video interaction, indicating that an alternative procedure was used and retaining clear copies of the documents presented. Missing one of these steps may leave the Form I‑9 vulnerable during an audit.
